In Queensland, pool safety laws are strict, and the fines are even stricter. If a pool fence is found to be non compliant, the Queensland Government can issue on-the-spot penalties starting from $989, and the fines can climb up to $6,192 for serious or repeated breaches. Local councils also conduct random inspections, so even if no one reports the property, you can still face penalties.
The moment a fence fails height requirements, has climbable gaps, broken latches, or isn’t properly maintained, it’s considered non compliant. And once it’s flagged, owners are legally required to fix issues immediately. For rental properties, both the landlord and the property manager can be fined if the pool barrier isn’t up to standard.
Common Reasons Pool Fences Fail in QLD
1. Fence Height Issues
Pool barriers must be at least 1200 mm high. Even a garden bed or accumulated soil can reduce the effective height and make the fence non compliant.
2. Climbable Objects in the Non-Climb Zone
Things like barbecues, pot plants, chairs, retaining walls, and outdoor furniture inside the 900 mm non-climbable zone cause instant fails.
3. Faulty or Non-Self-Closing Gates
Gates must shut and latch automatically. A slow hinge, misalignment, or worn latch is enough to fail an inspection.
4. Gaps and Footholds
Gaps under the fence must be less than 100 mm. Horizontal rails can also become footholds and break compliance if they’re too close together.
5. Structural Damage
Rust, loose panels, rotting timber posts, or broken glass panels are major safety hazards and result in fines if not repaired promptly.
How Pool Fence Inspections Work in Queensland
Initial Compliance Check
A licensed inspector assesses the entire barrier, gate mechanisms, boundary fencing, and non-climb zones. They compare your setup with Queensland Development Code MP 3.4, which outlines all pool barrier requirements.
What Happens After the Inspection
• Compliant fences receive a Pool Safety Certificate (Form 23), valid for two years for non-shared pools.
• Non compliant fences trigger a Form 26, which details all issues that must be fixed.
• If risks are severe or ignored, the inspector or council can report the property for enforcement, leading to penalties.
Random Council Audits
Councils use complaint-driven and random inspections. Even if your certificate hasn’t expired, you can still be checked and fined for safety defects.
